INTRUST AG has been advising entrepreneurs and families in relation to their private and business assets for more than 30 years. We help our clients to structure their business and private assets efficiently and support them by serving as board members and trustees.

Our experienced team is made up of lawyers, tax and trust experts, certified accountants, and compliance and IT professionals. We apply this wide-ranging knowledge – gained over many combined decades in the business, both in Switzerland and abroad – to achieve the right solution for each individual client.

INTRUST AG is a privately held company. It is supervised in Switzerland by the Financial Services Standards Association (VQF), a Self-Regulatory Organisation (SRO) officially recognised by the Swiss Financial Market Supervisory Authority (FINMA).

INTRUST AG follows the Economic Substance legislation introduced in the BVI which requires certain entities that are incorporated or registered in the British Virgin Islands, and which conduct one or more of a set list of relevant activities, to comply with local substance requirements known as ‘economic substance’.

The legislation follows closely the approach taken by the Crown Dependencies of the UK (Jersey, Guernsey and the Isle of Man) and the other UK Overseas Territories including Bermuda and the Cayman Islands.

Trust services

Trusts have their origins in Anglo-Saxon law, deriving from remedies granted by courts of equity or chancery. The trust concept is based on a triangular relationship: a settlor transfers assets to a trustee, who is then under a fiduciary obligation to deal with and hold these assets, acting in the interests of one or more beneficiaries. While the trustee becomes the legal owner of the trust assets, beneficial (or “equitable”) ownership lies with the beneficiaries, restricting the trustee’s rights over the assets.

With this privacy policy, INTRUST AG („INTRUST“) provides information on how it collects, obtains, uses, passes on and otherwise processes personal data. This is not an exhaustive data protection declaration; other data protection declarations, individual data protection declarations or information may apply to specific circumstances.

Personal data refers to all information relating to an identified or identifiable natural person.

 Origin and processing of personal data  

INTRUST processes personal data that it receives from business partners or other persons involved in the context of customer and contractual relationships with them. It also processes personal data that is collected from users when operating the www.intrust.ch website. If business partners transmit personal data of other persons to INTRUST, they must inform these persons of this data protection declaration in advance.  

In addition to the data that is disclosed to INTRUST, data that INTRUST receives from authorities or other third parties, publicly accessible data or data that becomes known to it as a result of the use of a service is also processed.  

The categories of personal data that INTRUST obtains from third parties include, in particular, information from public registers, information in connection with official or legal proceedings, information in connection with professional activities or functions of business partners, information about business partners in correspondence and meetings with them and with third parties, information about business partners, which are disclosed to us by persons in their environment, information on compliance with legal requirements such as anti-money laundering and export restrictions, information from banks, insurance companies and other contractual partners of INTRUST on the utilisation or provision of services for business partners and third parties, information in the media and on the Internet and data in connection with the use of the INTRUST website. 

Purposes of data processing 

INTRUST always processes personal data for a specific purpose. This is primarily the conclusion and fulfilment of contracts with business partners, in particular in the context of the provision of services to customers and the purchase of products and services from suppliers, as well as to comply with INTRUST’s legal obligations. 

In addition, INTRUST also processes personal data for the following purposes: 

  • The company’s                 services and website are being further developed;
  • Communication with third parties;
  • Customer care and marketing (unless business partners have explicitly objected to the use of their data);
  • Assertion of       legal claims and defence in the context of legal disputes and official proceedings;
  • Guarantee of    operation, in particular of IT and the website;
  • Compliance with             applicable legal and professional regulations and contractual agreements;
  • Corporate transactions (merger, purchase or sale of companies or transfer of assets).    

If a business partner grants consent for the processing of their personal data for specific purposes, such as receiving newsletters, INTRUST will only process the personal data within the scope of and based on this consent. The consent given can be revoked at any time.  

 Data transfer to third parties and data transfer abroad 

The personal data processed by INTRUST will be transferred to third parties, if necessary or appropriate, for the provision of services or fulfilment of other purposes defined in this privacy policy. These recipients of personal data can be assigned to the following categories: 

  • customers and their affiliated companies;
  • suppliers, their subcontractors and other external service providers (e.g. banks, insurance companies, accountants) and order processors (e.g. IT providers);
  • Domestic and foreign authorities, official bodies and courts, mediation centres and arbitration tribunals; 

The aforementioned recipients of personal data may be located in Switzerland or abroad. Accordingly, business partners must expect their personal data to be processed in Switzerland and abroad. 

If a recipient is located in a country without adequate data protection, INTRUST contractually obliges the recipient by means of recognised standard contractual clauses or relies on an exemption clause, such as consent, contract processing or an overriding public interest. 

 Data security 

INTRUST takes appropriate technical and organisational security precautions to protect the personal data of business partners from unauthorised access and misuse. 

 Cookies and tracking 

INTRUST uses cookies on the website. Cookies are small text files that are automatically stored on a computer’s hard drive when the website is visited. These cookies are used to collect statistical information about the use of the website by visitors on an anonymous basis. The information also enables the operator to optimise the functionality of the website. The website operator may cooperate with Google Analytics in the area of web analytics. Google Analytics also uses cookies. From the data stored in the Google Analytics cookie, Google Analytics learns which pages have been accessed in order to display appropriate advertising. Google Analytics cookies do not store any personal data. Most internet browsers accept cookies automatically. However, the storage of cookies on a computer’s hard drive can be prevented by adjusting the browser settings. Cookies stored on a hard drive can be deleted at any time. If a business partner does not agree to the use of cookies, the functionality of this website may be restricted. Data will not be passed on to third parties, neither for commercial nor for non-commercial purposes. 

 Rights of the data subject 

This data protection declaration also serves to provide business partners with the information required to enable them to assert the following rights to which they are entitled under the FADP: 

  • Right to information about existing personal data;
  • Right to rectification of personal data;
  • Right to erasure of personal data;
  • Right to restriction of processing of personal data;
  • Right to object to the processing of personal data;
  • Right to future-oriented revocation of a given consent;
  • Right to disclosure of personal data for the purpose of transfer.

Business partners also have the right to enforce their claims in court or to lodge a complaint with the competent data protection authority.  

INTRUST reserves the right to assert legal restrictions, such as statutory retention or processing obligations or the existence of an overriding interest in data processing. The assertion of rights to which business partners are entitled may result in INTRUST no longer being able to provide the agreed services and may result in the cancellation of the contract.

INTRUST reserves the right to amend this privacy policy at any time without prior notice. The version published on the website https://www.intrust.ch is the currently valid version.
